Governor Hochul Takes Bold Step With Data Center Executive Order

Today, New York Governor Kathy Hochul announced executive action aimed at addressing some of the challenges posed by data center development. The executive order includes a temporary statewide moratorium on new, hyperscale data center development (50MWs) for up to one year, orders the Department of Environmental Conservation to temporarily halt the issuance of discretionary State environmental permits for these facilities, and a new Public Service Commission standard requiring data centers to either pay higher energy rates or supply their own power to protect local ratepayers.

In response, Evergreen Northeast and Mid-Atlantic Regional Director Eric Miller released the following statement:

“Today, Governor Hochul has taken a bold step to address the complex challenges presented by data center growth across the state. We look forward to continuing to work with the Governor, her administration, and partners to create a framework for data centers to support the rapid build-out of new, clean energy resources to further address both the climate and affordability crises in the Empire State.”
